He basically has kidnapped him. If a person has legal custody of a child, and the non custodial parent takes them and doesn't return them, that is the definition of kidnapping. That's how the law works in the USA. Last I heard, hope has LEGAL guardianship of Douglas. That means she is the custodial parent.

Elle, they haven’t elaborated on what the custody agreement actually states. But I get the impression Hope’s cabin is “home base”, and Thomas has visitation rights. Thomas has been more than happy to let Hope do all the heavy lifting for years. I didn't realize it was a competition, Lynn. I have been stating all along (not just today) that Hope is Douglas' adoptive mother. I never disputed that, so I'm not sure what was "won." You don’t take Douglas and agree to 1 overnight, then just decide to keep him for 3 days cuz it suits you!!! Do people understand what adoption and family court are? You can't just take a child and refuse to return that child because they are your blood. Not when there are legal documents involved. Lynn, you should look at those old shows before commenting on what you do not know. Brooke and Hope underhandedly got Thomas to sign maternal rights over to Hope. There was no discussion, no lawyer, no nothing, except for Brooke producing papers to Hope and telling her what she should do. It wasn't until some time after that when Thomas started to realize that he needed help, did he ask Hope to take care of Douglas until he got better.
My point about the papers is that if they decided to go to court, those papers can be deemed null and void and Hope will no longer be considered Douglas mother. Sure Thomas will probably speak up and say that he still wants Hope in his son's life but legally, she would no longer be his mother.

The absolute only way a judge would “rip up the adoption papers” would be if Hope proved to be a negligent parent. And we both know that will never happen. And even in that case, the papers wouldn’t be ripped up. She would just lose her custodial rights. Hope is by far the most sane rational one in the bunch. A judge will never find fault in Hope. Not ever.
Dad's are important in a child's life. So, Liam should insist on Kelly coming to live with him. Afterall, Kelly is a Spencer & she should be living in a Spencer house. Regardless of whether Thomas deserves to have joint physical custody remains to be seen. But Thomas is using the logic - possession is 9/10ths of the law. And that DOES NOT apply to children! You don’t take Douglas and agree to 1 overnight, then just decide to keep him for 3 days cuz it suits you!!! You return him to Hope per your agreed arrangement, and then you go battle it out in court if need be.
As much as all the Forrester lovers will get enraged, it needs to be said….Thomas is breaking the court agreement by not retiring him to Hope like he said he would. And if they do end up in court, a judge will not look favorably on that at all.
And Brooke is 100% correct, this is all part of Taylor’s and Steffy’s plan to draw a huge line in the sand between the Logans and the Forresters. Very, very immature women!! Grow up!

DeleteDo people understand what adoption and family court are? You can't just take a child and refuse to return that child because they are your blood. Not when there are legal documents involved. I would think Finn, having been adopted, might take issue with steffy's bullshit remarks about family. I wouldn't let Thomas keep my dogs, much less a kid. I don't see that he's made any life altering changes. This whole story line is just the newest excuse for the Foresters and Logan's to be at war. On a different note all the women had terrible hair today. especially Hope. She and Brooke both need some dye jobs too. I'm so sick of seeing Taylor's bangs in her damn face.

DeleteLynn, you should look at those old shows before commenting on what you do not know. Brooke and Hope underhandedly got Thomas to sign maternal rights over to Hope. There was no discussion, no lawyer, no nothing, except for Brooke producing papers to Hope and telling her what she should do. It wasn't until some time after that when Thomas started to realize that he needed help, did he ask Hope to take care of Douglas until he got better.
DeleteMy point about the papers is that if they decided to go to court, those papers can be deemed null and void and Hope will no longer be considered Douglas mother. Sure Thomas will probably speak up and say that he still wants Hope in his son's life but legally, she would no longer be his mother.
Elle, I WAS watching then. I started watching the show long before Hope adopted Douglas. Everyone agreed it was the right thing. And as another poster commented, if the Forresters had some issue with the legality of the agreement, they wouldn’t have waited YEARS to contest it!!! What you are saying holds no water!

DeleteThe absolute only way a judge would “rip up the adoption papers” would be if Hope proved to be a negligent parent. And we both know that will never happen. And even in that case, the papers wouldn’t be ripped up. She would just lose her custodial rights. Hope is by far the most sane rational one in the bunch. A judge will never find fault in Hope. Not ever.
DeleteDad's are important in a child's life. So, Liam should insist on Kelly coming to live with him. Afterall, Kelly is a Spencer & she should be living in a Spencer house. Also, Kelly needs bonding time with her half sister, Beth. Maybe, if that happened, Steffy could understand that the adults need to compromise for the sake of the children. Instead, we have two grandmothers acting like spoiled brats squirting paint all over each other & making a mess in somebody else home. I wonder if Eric is going to call that mess "art"? Any judge is going to view Thomas behaviour questionable at best. He abused that child terribly and had him terrified of him. I`m sure that little boy believes that if things go south he can go home to his mum,at any time. I just love the way the pro Steffy/Taylor people like to try to compare that Brook asked him not to mention Santa, to the degree of utter abuse Thomas targeted this little boy with.
